Criminal Appeals

When appealing a criminal conviction, you are requesting that a higher court decide an issue that you believe was improperly decided by a Trial Court. Many times, an innocent man or women has been convicted of a crime in the Trial Court based upon an error of law, an error of fact or both. Attorney Faigel brought the case to the Court of Appeals and argued that the facts of the case, as presented to the jury at trial by the prosecutor, did not prove beyond a reasonable doubt, that the defendant had been involved in a drug offense. Although the jury had found his client guilty at trial, the Court of Appeals reversed the convictions and set aside the verdicts. As a result, the client was immediately released from jail and the convictions were erased from his record.

Appellate Courts have their own set of rules which can complicate the process. A successful appeal requires a solid understanding of the facts, as well as the law. Additionally, a successful appeal requires the ability to craft a well written legal brief as well as the ability to present a cohesive and persuasive oral argument to the Court.

In many cases, a notice of appeal must be filed within 30 days after a conviction or sentencing, whichever is later.
